Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and HRS Tech ("VeloSend", "we", "us", "our"), the operator of VeloSend at velosend.net.

By accessing or using VeloSend in any way — including browsing the website, initiating a file transfer, or installing the Progressive Web App — you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction), have read and understood these Terms, and agree to be bound by them.

This applies whether or not you create an account. VeloSend's free tier can be used without signing in, but using the service anonymously does not exempt you from these Terms or our Privacy Policy. By initiating or receiving a transfer without an account, you automatically accept these Terms and the Privacy Policy in full, to the same extent as a registered user. If you create an account, you will be asked to affirmatively accept these Terms and the Privacy Policy during registration.

VeloSend is a browser-based, peer-to-peer (P2P) file transfer application. It uses WebRTC technology to create a direct, encrypted channel between two browsers. Files you send are transmitted directly between devices and do not pass through, or get stored on, VeloSend's servers at any point during a transfer.

Our servers are used exclusively for signaling (helping two devices discover each other and establish a direct connection) and, where a direct P2P connection is not possible, for TURN relay traffic. No file contents are ever stored, logged, or accessible to us.

We offer both a free tier and optional paid subscription plans ("Pro" and "Family"). Free tier capabilities and paid plan features are described on our Pricing page.

You agree to use VeloSend only for lawful purposes and in compliance with all applicable laws and regulations. You must not use VeloSend to:

• Transfer files that you do not have the right to distribute, including copyrighted material without authorization.
• Transmit malware, viruses, ransomware, spyware, or any other malicious code.
• Distribute child sexual abuse material (CSAM) or any illegal content involving minors.
• Engage in any activity that violates the privacy, intellectual property rights, or other rights of any third party.
• Circumvent, disable, or interfere with any security features of VeloSend.
• Attempt to gain unauthorized access to any portion of VeloSend's infrastructure.
• Use automated scripts, bots, or crawlers to interact with the service in ways that create disproportionate load.
• Resell or sublicense access to VeloSend's infrastructure to third parties.

Because all file transfers are end-to-end encrypted and peer-to-peer, VeloSend does not have technical access to inspect file contents. You are solely responsible for all files you transfer using our service. We reserve the right to terminate accounts we have credible reason to believe are involved in illegal activity.

The free tier of VeloSend requires no account creation. Paid plans (Pro, Family) will require account registration. When creating an account, you agree to provide accurate, current, and complete information and to keep your credentials secure. During registration you will be required to affirmatively confirm that you accept these Terms of Service and our Privacy Policy before your account can be created; you cannot complete registration without doing so.

Paid subscriptions are sold and billed by our payment provider, Creem ("Creem"), operated by Armitage Labs OÜ, who acts as the merchant of record for all Pro and Family purchases — see Creem's Buyer Terms for the full terms that apply to your purchase. This means your purchase is a transaction with Creem, not directly with HRS Tech — Creem is responsible for processing your payment, calculating and remitting any applicable sales tax or VAT, and issuing invoices and receipts.

New Pro and Family subscriptions include a 7-day free trial; you will not be charged if you cancel before the trial ends. By subscribing, you authorize Creem to charge the applicable fee to your payment method once the trial ends, and on a recurring basis thereafter until you cancel. You may cancel your subscription at any time from your account settings. Cancellation during the trial stops the upcoming charge entirely; cancellation after you've been charged takes effect at the end of the current billing period.

Plan pricing and features are subject to change. We will provide at least 30 days' notice via email before changing the price of an existing active subscription.

The following limitations apply to free-tier users:

• Maximum file size: 5 GB per file.
• Maximum files per transfer: 10 files simultaneously.
• Room duration: 30 minutes.
• Maximum receivers per room: 1.
• TURN relay usage: limited to 5 GB per calendar month (requires sign-in).

VeloSend may change any of the limits above — or any limits applicable to paid plans — at any time, at our sole discretion, without prior notice. Continued use of the service after a limit change constitutes acceptance of the revised limit.

VeloSend and all associated software, designs, logos, and content are the exclusive property of HRS Tech and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the service for personal, non-commercial purposes, subject to these Terms.

You retain full ownership of all files you transfer using VeloSend. We make no claim to any proprietary rights over your content.

Your use of VeloSend is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully to understand how we handle your information.

VeloSend is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or free from harmful components. You use VeloSend at your sole risk.

To the fullest extent permitted by law, HRS Tech and its officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use VeloSend, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from these Terms or your use of VeloSend shall not exceed the greater of (a) the amount you paid us in the 3 months preceding the claim or (b) US $10.

You agree to defend, indemnify, and hold harmless HRS Tech and its affiliates from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of VeloSend; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any files you transfer using the service.

We may suspend or terminate your access to VeloSend at any time, with or without notice, for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the service ceases immediately.

You may stop using VeloSend at any time. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

We reserve the right to update these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of VeloSend after any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the service.

These Terms are governed by the laws of the jurisdiction in which HRS Tech is registered, without regard to conflict of law principles. Any disputes arising from these Terms or your use of VeloSend shall first be attempted to be resolved informally by contacting us. If the matter cannot be resolved informally within 30 days, it shall be submitted to binding arbitration.
